PARTICIPANT AGREEMENT, RELEASE, AND ASSUMPTION OF RISK

In consideration of the services of Comunidad Connect, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "CC"), I hereby agree to release, indemnify, and discharge CC, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. Background. CC has, at my request, agreed to provide certain services (described further below) to me and, if applicable, my minor children (the “Participating Children”), provided that I agree to a fair and reasonable allocation of the associated risks. The terms of this agreement are CC’s proposed allocation of risk. I understand that if I wish to utilize CC’s services but have objections or complaints about this agreement, I or my attorney may contact CC or its attorney at info@comunidadconnect.org to negotiate a mutually satisfactory allocation of the risks involved in such services and the costs associated with providing the services and associated liability insurance, and further understand that CC will negotiate such changes with me in good faith.

2. Activity Risks. I acknowledge that my participation in service-based activities such as farm work, construction, painting, gardening, school and other site visits, and sustainable tourism activities such as touring, canopy zip-line tours, kayaking, hiking, volcano boarding, horseback riding, surfing, sporting activities and swimming entail known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activities. While CC guides hold the safety of participants as their first priority, they are not infallible. They might be unaware of a participants’ fitness or abilities. They might misjudge the weather, the elements, or the terrain. They may give inadequate warnings or instructions, and the equipment being used might malfunction. I expressly agree and promise to accept and assume all of the risks existing in the activities. My participation in the activities is purely voluntary, and I elect to participate in spite of the risks.

3. Travel Risks. International travel has dangers and risk associated with it. I acknowledge that risk of participation exists and includes among other things: hazards of travel in rural areas, densely vegetated areas, mountains, hill sides, and steep terrain, risk associated with weather and forces of nature, risk associated with travel by public or private bus or van, boat, plane, truck, horse, foot, bicycle and other conveyance, hazards of slips and falls, rockfall, exposure to insect and snake bites, hazards that may be associated with my physical condition, risk of crime, civil unrest, injury or illness in remote areas without means of rapid evacuation or adequate medical care, supplies, or facilities. I agree that CC shall have no liability for these travel risks and shall not be liable for the adequacy of medical care and supplies that may be provided.

4. VOLUNTARY RELEASE AND NEGLIGENCE. FOR ME AND MY MINOR CHILDREN, AND FOR THE SUCCESSORS, HEIRS, EXECUTORS AND ADMINISTRATORS OF ANY OF THE FOREGOING (COLLECTIVELY, THE “RELEASING PERSONS”), I HEREBY WAIVE, RELEASE, DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS CC FROM AND AGAINST ANY AND ALL CLAIMS AGAINST CC BY THE RELEASING PERSONS OR ANY OF THEIR EMPLOYEES, AGENTS AND INVITEES, AND ALL LIABILITIES THEREON, FOR LOSSES OR DAMAGES, INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF CC, WHICH ARISE OUT OF OR RELATE TO MY PARTICIPATION IN THIS ACTIVITY, THE SERVICES PROVIDED BY CC, OR MY USE OF CC’S EQUIPMENT OR FACILITIES, INCLUDING BUT NOT LIMITED TO INJURY, ILLNESS, OR DEATH, AND FOR ALL EXPENSES, INCLUDING BUT NOT LIMITED TO ATTORNEYS FEES, INCURRED IN DEFENDING ANY SUCH CLAIMS; PROVIDED, HOWEVER, THAT THIS PARAGRAPH (4.) SHALL NOT APPLY TO CLAIMS FINALLY ADJUDICATED TO HAVE ARISEN FROM THE WILLFUL OR INTENTIONAL MISCONDUCT OF CC

5. ATTORNEY’S FEES. SHOULD CC OR ANYONE ACTING ON THEIR BEHALF, BE REQUIRED TO INCUR ATTORNEY'S FEES AND COSTS TO ENFORCE THIS AGREEMENT, I AGREE TO INDEMNIFY AND HOLD THEM HARMLESS FOR ALL SUCH FEES AND COSTS.

6. Insurance and Health Condition. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions which could interfere with my safety in this activity, or else I am willing to assume - and bear the costs of - all risks that may be created, directly or indirectly, by any such condition.

7. LOCATION OF SUIT. IN THE EVENT THAT I FILE A LAWSUIT AGAINST CC, I AGREE TO DO SO SOLELY IN THE STATE OF COLORADO, AND I FURTHER AGREE THAT THE SUBSTANTIVE LAW OF THAT STATE SHALL APPLY IN THAT ACTION WITHOUT REGARD TO THE CONFLICT OF LAW RULES OF THAT STATE. IF I, OR ANYONE ACTING ON THEIR OR MY BEHALF, SHOULD BRING SUCH SUIT, I/THEY SHALL PAY ALL REASONABLE ATTORNEY FEES, COURT AND COSTS OF DEFENSE SHOULD I/THEY NOT PREVAIL.

8. Severability. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

BY SIGNING THIS DOCUMENT, I ACKNOWLEDGE THAT IF ANYONE IS HURT OR PROPERTY IS DAMAGED DURING MY PARTICIPATION IN THIS ACTIVITY, I MAY BE FOUND BY A COURT OF LAW TO HAVE WAIVED MY RIGHT TO MAINTAIN A LAWSUIT AGAINST CC ON THE BASIS OF ANY CLAIM FROM WHICH I HAVE RELEASED THEM HEREIN.

MEDIA PERMISSION FORM

I hereby grant the registered 501 (c) (3) non-profit, Comunidad Connect the absolute and irrevocable right and unrestricted permission in respect of photographic portraits or pictures, video or audio recordings, that have been taken of me or in which I maybe included with others. The non-profit organization may use, publish, and republish the same photographs or recordings in whole or in part, individually, in any and all media now or hereafter, and for any purpose whatsoever, for illustration, promotion, art, editorial, advertising and trade, or any purpose whatsoever without restriction as to alteration; and to use my name if the non-profit organization chooses. I hereby release and discharge the registered 501 (c) (3) non-profit, Comunidad Connect from any and all claims and demands arising out of or in connection with the use of photographs, including limitations any and all claims for libel or invasion of privacy. I am of full age and have the right to contract in my own name. I have read the foregoing and fully understand the contents thereof. This release shall be binding upon my heirs, legal representative, and assigns.
